Following the conclusion of oral evidence in class action proceedings concerned with allegations of statutory unfairness pursuant to s 180A of the National Credit and Consumer Protection Act 2009 (Cth) (NCCPA), the defendants objected to the tender of various categories of documentary evidence, and in a number of instances sought that documents be admitted subject to a limitation under s 136 of the Evidence Act 2008 (Vic).
