The applicant (Steve), the first respondent (Chris), the second respondent (Kasiani) and the third respondent (Mary) were members of a family that held interests in a portfolio of properties through various superannuation funds, trusts and partnerships. The family members were parties to a proceeding relating to the properties and entered into a settlement deed to resolve the dispute. The deed relevantly provided for the sale of eight of the properties, the discharge of liabilities and the distribution of the proceeds of the sales.
