A., a solicitor who had acted for many years in that capacity for the defendant, was asked by the defendant to procure a partner for him in his trade A. said that if he did so he would require a commission of 50l.; the defendant said that that would be a fair charge. A. procured a partner, and sued the defendant in the police court for the 50l. as and for work and labour done. The justices dismissed the complaint, on the ground that, inasmuch as the relationship of solicitor and client was existing between A. and the defendant, the former could not maintain a claim in such form.
