Per Sholl J.: Where, in a civil trial, a serious assault amounting to a crime is alleged, the onus is on the plaintiff to prove the defendant’s actions according to the civil standard. Such an assault must be proved to the reasonable satisfaction of the Court, having due regard to the magnitude of the matter that is in issue. A similar standard applies in respect of a defendant’s plea of justification. In neither case is it necessary to prove intent.
