The defendant, a farmer, was the owner of an enclosed paddock in which the plaintiff’s three dogs were found at large among the defendant’s sheep, some of which they had attacked and injured. The defendant’s sister captured the dogs and locked them in a shed, where they were kept for about five hours, until the defendant, having well founded fears that the dogs would escape from the shed and renew their attack upon the sheep, poisoned them.
