A husband, administrator of his wife’s land, entitled beneficially to one-third for himself, and holding the other two-thirds for his children, borrowed money from a bank and expended it in improving the whole of the property, which he mortgaged to the bank to secure the repayment of the sums borrowed. The bank advanced the money, and took the mortgage, with notice of the children’s interest.
