A creditor took out in 1865 letters of administration of the personalty of a deceased person, and entered into possession of a portion of the deceased’s real estate. The plaintiff filed his bill against the administrator alleging himself to be heir-at-law of the deceased, seeking for a conveyance of the real estate, and an account of the rents received by the administrator.
