Following an incident which occurred during the running of a race at a harness race meeting, the applicant saw the chief steward in the stewards' room and expressed criticism of the way in which the Harness Racing Board had carried out its functions of controlling harness racing, both in general terms and in relation to the incident which had just occurred. As a result he was charged under the rules of the Harness Racing Board with improper or offensive behaviour. The applicant sought, but was not given, particulars of the charge against him. He was found guilty before the stewards and a penalty was imposed. An appeal to the Harness Racing Board was dismissed. The applicant obtained an order nisi pursuant to the Administrative Law Act 1978 to review the decision of the Board.
