A creditor of a deceased person who waits a considerable time after the death before taking steps to prove his debt, and apply as on an intestacy, for administration of the deceased’s estate, and who is ignorant that the deceased has left a will, will be allowed his costs out of the estate, although the executors of that will may be entitled to probate.
