A was entitled under a settlement to an annuity or rent-charge over Whiteacre. Under the will of the owner in fee the estate was devised in strict settlement, subject to the annuity. Rabbits came on to Whiteacre in such numbers as in a few years, if the pest were not at once exterminated, would render it unprofitable unless at a cost of 10,000l. for clearing it. On motion, by the executors of the will, for leave to spend 1300l. during the course of three years, one-half out of the income of the estate and one-half out of A’s annuity:—
