A document, dated the 18th December 1944, was propounded as the will of a testator. A letter had been written by the alleged testator to his brother, dated the 14th July 1945, which contained the statement, "I have not yet been able to make my will." It was submitted by the caveator that the letter was admissible in evidence under sec. 3 of the Evidence Act 1946, as being a statement in a document tending to establish the fact that the document propounded was not the will of the testator.
