Where executors and trustees, or (semble) administrators, apply to the Court by way of originating summons for liberty to pass their accounts before the Chief Clerk, and for an order that on the passing of the accounts they be allowed, under sec. 34 of the Administration and Probate Act 1915, commission for their pains and trouble, they are, in the absence of special circumstances, entitled out of the estate to the costs of the application for leave to pass their accounts in order to obtain commission.
