A testator by his will devised to his son a life interest in certain land on which there was growing, at the testator’s death, a crop of wheat which had been sown by a share-tenant under an agreement with the testator, by the terms of which the testator was to be entitled to have a certificate for one-third of the wheat, which, having been sown and harvested by the share-tenant, should in due course be delivered to a wheat agent at a railway station.
