The plaintiff put the defendant, who was a builder, in possession of certain lands for the purpose of erecting a house thereon. Upon the completion of the house the defendant refused to give up possession. The plaintiff thereupon brought an action of ejectment, and the defendant during the trial sought to adduce evidence to prove that the plaintiff had no title to the land; the evidence was rejected.
