A mining company entered, into an agreement with a tributor (in the agreement called the contractor) enabling him to mine on their land, and take and remove all gold &c. therefrom, receiving from the company an amount, as wages, proportionate to the amount of gold he extracted. The agreement provided that the mine and all gold taken therefrom should for all purposes be deemed to be the property of the company, and further that the ground to be worked, should be such portions of the company’s claim as the mine manager of the company might determine from time to time during the continuance of the agreement.
