Section 82(2) of the Accident Compensation Act 1985 provided that a worker's dependants were entitled to compensation under the Act if there was caused to the worker an injury arising out of or in the course of any employment and if the worker's employment was a significant contributing factor which resulted in or materially contributed to the death of the worker. Section 83(1)(a) of the Act provided that an injury to a worker was deemed to arise out of or in the course of employment for the purposes of s 82(2) if the injury occurred:
