REGINA v. DRAKE Supreme Court of Victoria (Full Court) HIGINBOTHAM, C.J., WILLIAMS, and A’BECKETT, JJ. 01 September 1887 Abortion — Criminal Law and Practice Statute 1864, sec. 56 — Supplying drugs with intent that they should be used to procure abortion — Pretence by persons seeking such drugs, as to existence of woman on whom they were to be used .

To constitute an offence under sec. 56 of the Act, it is not necessary to prove the existence of a woman for whose use the drug was supplied; it is sufficient to show that the drug was supplied with the intent that it should be used for an unlawful purpose, or with the belief that the person to whom it is supplied intends to use it for such a purpose.
